1.  RENT, TERM, CHARGES

RENT  I agree to rent one (1) cart (including supplied strap and lock)and/or wheelchair(and lock) for one rental week.

RENTAL WEEK  The rental week runs from Saturday to Saturday 10am.

FAILURE TO HAVE THE CART and/or WHEELCHAIR READY FOR RETURN  AT THE CLOSE OF YOUR RENTAL WEEK MAY RESULT IN A  CHARGE IN ADDITION TO RENT.

CHARGES  I agree that upon my failure to deliver or return the cart and /or wheelchair by the end of the rental week, my credit card may be charged  to replace the missing cart.  I agree that upon my return of the cart and/or wheelchair with any damages (normal wear and tear excepted), my credit card may be charged  to replace the damaged cart and/or wheelchair.  I agree that upon my failure to deliver or return the lock by the end of the rental week, my credit card may be charged  to replace the missing lock.  I agree that upon my failure to deliver or return the strap by the end of the rental week, my credit card may be charged  to replace the missing strap

2.  APPROPRIATE USES, DISCLAIMER OF LIABILITY, ABSOLUTE RELEASE. APPROPRIATE USES

The cart is designed and intended for the transportation of items and goods with a combined weight of not more than 220lbs.The wheelchairs is designed and intended for the transportation of persons with mobility problems, must never be unattended when occupied, weight limit is 325lbs.

NOTICE.  RELEASING A STRAP – WHEN STRETCHED – MAY CAUSE INJURY TO PERSONS, ANIMALS OR PROPERTY.

DISCLAIMER OF LIABILITY. THE WHEELCHAIR, THE CART, LOCK AND STRAP ARE RENTED TO AND BY YOU AS-IS WHERE- IS, AND SUBJECT TO AN ABSOLUTE AND IRREVOCABLE  DISCLAIMER OF ANY AND ALL WARANTIES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARANTY OF FITNESS FOR ANY PARTICULAR PURPOSE.

ABSOLUTE RELEASE. By entering into this agreement and accepting the cart, lock and strap,and/or wheelchair you expressly and irrevocably release, hold harmless and indemnify BEACHEASYNJ, LLC (together with its owners, employees, agents and assigns) from any and all liability of any kind arising from and/or attributable to your possession and/or use (whether proper or otherwise) of the cart, lock and strap and/or wheelchair.

3. CANCELLATIONS

All orders are subject to a $25 cancellation fee. If your order is cancelled less than 7 days prior to agree rental date, you will be charged in full.

4. RESERVATIONS

If you make a reservation to a beach town outside of Long Beach Island, 08008 (Beach Haven, Ship Bottom, Surf City, Harvey Cedars, Barnegat Light, Long Beach Township)  Ocean City NJ or Sea Isle City without prior approval, you will be charged a $10 processing/cancellation fee.

By making a reservation and processing your credit card, you agree to the above terms.
